Terms of Service
These Terms govern access to the PeerSure website, public trust materials, and the software services made available by Branscum Labs. If your organization has a separate written agreement with us, that agreement controls to the extent of any conflict.
1. Scope and acceptance
By accessing or using the site or services, you agree to these Terms on behalf of yourself and, where applicable, the organization you represent. You must have authority to bind that organization.
2. Enterprise agreements control
If your organization has a master services agreement, subscription agreement, order form, business associate agreement, or other written contract with us, that agreement will govern your organization's use of the services and control over these Terms to the extent of any inconsistency.
3. Eligibility and account access
- Accounts are intended for authorized business users.
- Access may be provisioned by your organization, by single sign-on, or by approved administrator workflow.
- You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
- You must promptly notify us at support@peersure.net if you suspect unauthorized access.
4. Acceptable use
- You may use the services only for lawful business purposes and in accordance with applicable contracts and policies.
- You may not reverse engineer, interfere with, disrupt, probe, scrape, or misuse the services.
- You may not use the services to store or transmit data in violation of law, contract, or any applicable privacy or security obligations.
- You may not attempt to bypass authentication, authorization, logging, or other security controls.
5. Customer data and confidentiality
As between the parties, customer data remains subject to the rights and obligations set out in the applicable customer agreement. We will handle customer data in accordance with that agreement, this site’s public Privacy Notice, and any applicable business associate or data protection terms.
6. Security and regulated workflows
We maintain administrative, technical, and organizational safeguards appropriate to the services we provide. Certain regulated workflows, including deployments that may involve protected health information, may require additional documentation, configuration, approvals, and executed agreements before use.
7. Intellectual property
We and our licensors retain all right, title, and interest in and to the site, services, software, documentation, and related materials, including all associated intellectual property rights. Except as expressly permitted by law or contract, no rights are granted other than the limited right to use the services in accordance with these Terms or the applicable customer agreement.
8. Feedback
If you provide suggestions, comments, or other feedback, we may use that feedback without restriction or obligation, provided that we do not publicly identify you or disclose your confidential information.
9. Availability and changes
We may update the site or services from time to time, including to improve features, security, performance, or compliance posture. We may suspend or limit access where reasonably necessary for maintenance, security, or contractual reasons.
10. Disclaimers
Except as expressly set out in a written agreement, the site and public materials are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, or data, arising out of or relating to these Terms. The liability limitations in any separate written customer agreement will control to the extent applicable.
12. Termination
We may suspend or terminate access if these Terms are violated, if required by law, or where continued access creates a security or operational risk. Your organization may also deactivate or revoke your access at any time.
13. Governing law
These Terms are governed by the laws of Oklahoma, excluding conflict-of-law rules, unless a separate written agreement states otherwise.
